OVERALL AIM AND SUMMARY OF JOB 

Help the company to accomplish its Labour and Strategic objectives by evaluating and improving the effectiveness of operational procedures within the company, labour disputes, disciplinary procedures and governance processes and any internal activities.

The incumbent must ensure that labour disputes and grievances are minimized by developing and maintaining effective procedures that ensures effective communications between management and employees. S/he is responsible for monitoring compliance with appropriate industrial legislation, industrial relations indicators.

      IR Compliance

  • Identify and evaluate internal procedures (grievances lodged and disciplinary hearings) and suggest improvements where deficiencies are identified.
  • Scrutinize the disciplinary rights and procedures applicable within the company for any grievances and labour disputes which affect the employees and company and recommend improvements.
  • Assist the HR and Legal Executive in ensuring the relevant laws, e.g. Labour Act, Employment Services Act, Affirmative Action Act, etc. applicable to labour issues are correctly observed in the company.
  • Guide the process to be followed when disciplinary hearings are to be conducted.
  • Guide the process to be followed when grievances are lodged by employees.

 

      Execution of disciplinary matters

  • Assist in compiling suspension letters, disciplinary hearing notices and any other sanction documents.
  • Assist in compiling evidence for hearings, viewing footage, saving footage and submit evidence.
  • Initiate at disciplinary hearings and prepare witnesses.
  • Represent the Company at arbitration hearings when required (subsequent to internal remedies fully exhausted).

      Reporting

  • Draft grievances findings, notice of disciplinary hearings, written submissions in arbitration hearings and any other official documents within the scope of work.
  • Discuss and explain findings with senior management to confirm findings.

      Legal

  • Draft and peruse through contracts and legal documents for the company.
  • Draft legal submissions / legal opinions and applications.
  • Provide legal advice on corporate related matters.
  • Assist in High Court matters where required.

      General

  • Attend to any reasonable request made by Management, Directors or Shareholders.
  • Attend meetings and training courses, workshops or seminars as required.
  • Relieve and assist in all areas during periods of absence or crisis.
  • Maintain the Company’s standards and adhere to policies and procedures.
  • Do branch inspections as required.

 

      JOB AND PERSON SPECIFICATIONS

      Qualifications

      Grade 12

      Relevant degree in Law (LLB or Bjuris)

      Admission as a Legal Practitioner will be an added advantage.

      Experience

      At least three-years’ experience in labour related matters

      Labour experience within the retail industry will be an added advantage.
